Paddlesports Activity Booking Confirmation, Terms and Conditions:


“Jervis Bay Kayaks and Paddlesports”  (JBK) will provide all paddling equipment in good working order and confirms that it holds all the required permits, licenses and insurances to facilitate the activity and operate in the Jervis Bay area. JBK will be guiding the SUP, Kayak or Snorkelling Tour (the “Activity”) and will be supervising the individuals taking part, including providing a full safety, weather and skills briefing prior to commencement of the Activity. During guided kayak activities, JBK will utilise double sit-on-top kayaks where possible, with a single sit-on-top kayak for odd numbers.

 
Participation Terms of Conditions of the Activity are as follows:


•    Any and all individuals taking part (the “Participants”) must accept these Terms and Conditions and complete the Assumption of Risk, Liability Release and Medical Information Agreement prior to taking part in the Activity (these documents are to be signed by a legal guardian for any participants under the age of 18).
•    The Participant must adhere to the safety and weather restrictions outlined in the activity briefing including any and all restrictions with respect to designated paddling areas and time of the activity. The participant acknowledges receiving an up to date weather and risk briefing prior to commencing the activity.
•    All Participants must follow the instructions of JBK guides during the activity.
•    Full payment is required to complete the booking, prior to the activity taking place. Please see our cancellation policy for more information.
•    JBK reserves the right to change the location of the activity due to weather / safety factors. The location will remain within the local area of Jervis Bay and surrounding waterways (and may include Currambene Creek, Moona Creek, St Georges Basin and various locations in Jervis Bay itself). 
•    JBK reserves the right to cancel the activity due to unsafe weather conditions. This will be solely at JBK’s discretion. In the instance of cancellation due to poor weather and/or safety, JBK will provide a full refund for the activity or agree on an alternative date. For avoidance of doubt, rain, overcast conditions, moderate wind or cold (unless significant) are not risk factors that would in themselves cause the cancellation of an activity.
•    JBK will not be liable for any costs or loss suffered by the participant as a result of cancellation or change of venue.
•    The participant is responsible for the equipment used during the period of the activity and will be liable for any damage caused by the participant to any third party and/or their property during the activity.
•    The participant must return all of the equipment at the completion of the activity.
•    JBK will not be held responsible for any loss or damage of any personal property of any participant taking part in the activity.
•    Where the participant taking part is under the age of 18, a legal guardian of the participant will take part in the activity and will supervise the participant.  
•    The participant must be no less than 5 years old and each child under the age of 14 years must be supervised by an adult at the ratio of 1:1, ie 1 adult to each child under 14 years.
•    The participant (or their legal guardian if under the age of 18) agrees to these Terms and Conditions prior to the commencement of the activity.
•    All persons taking part in the activity meet the following:
o    Are competent swimmers and have no medical conditions that would impede their ability to swim, or take part in an on-water paddling activity (please let JBK staff know if you cannot swim and we can accommodate you on the water).
o    Will, at all times while on the water, be wearing an Australian approved life jacket (if on a kayak) or a leg / ankle leash (if on a stand up paddleboard “SUP”).
o    Will not be under the influence of alcohol or drugs at any time during the activity and will remain under the blood alcohol limit of .05.
o    Adhere to the Marine Mammals Protection Act which requires a minimum distance of 100 mtrs be maintained from any marine mammal, including Whales, Dolphins, Seals and Sea lions.

o    If under the age of 18 the participant will remain under the supervision of their legal guardian while in the activity.
